Child Safety Policy (CSAE & CSAM Official Policy)

Nexa Party ("we," "us," "our," or "the App") is a voice-based social networking application that allows users to create and join voice chat rooms, connect with others, and engage in real-time voice conversations. We are committed to providing a safe environment for all users, with special protections for minors.

This Child Safety Policy outlines our standards against CSAE (Child Sexual Abuse and Exploitation) and CSAM (Child Sexual Abuse Material), in compliance with Google Play's Child Safety Standards and other applicable child protection laws. The specific legal frameworks that apply depend on the App's minimum age requirement (see Section 3).

This policy should be read in conjunction with our Privacy Policy and Terms of Service.

1. Zero-Tolerance Policy Against CSAE and CSAM

Nexa Party maintains a strict zero-tolerance policy toward Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM). We prohibit the creation, distribution, solicitation, facilitation, promotion, or possession of any content that constitutes or relates to CSAE or CSAM on our platform. Violations will result in immediate permanent account ban and referral to law enforcement.

For the purposes of this policy:

CSAE refers to any conduct that sexually abuses, exploits, or endangers a minor, including grooming, solicitation, sextortion, trafficking, and facilitation of child sexual abuse.

CSAM refers to any visual, audio, or written content that depicts, describes, or promotes the sexual abuse or exploitation of a minor, including real, simulated, or AI-generated content.

A minor is any person under 18 years of age. This definition follows the legal standard for child protection and applies regardless of the App's minimum age requirement (see Section 3).

2. Age Restrictions

Our App requires users to be 16 years of age or older to create an account and use our services. The App is not directed to children under 13.

We implement the following age verification measures:

● Requiring users to provide their date of birth or confirm they are 16 or older during account registration. Users who do not meet the requirement are blocked from creating an account.

● Relying on Google Play Console's age restriction tools and content rating (via the IARC questionnaire) to restrict access at the platform level.

● For users aged 13–15 in applicable EU member states, obtaining verifiable parental consent before processing their personal data, as required by GDPR Article 8.

● Monitoring for indicators of underage use and taking action when we become aware that a user below 16 may be using the App.

If we discover that a user is under 16 (or under the age of digital consent in their jurisdiction), we will immediately terminate the account, delete all associated personal information (except where retention is required by law), and take steps to prevent re-registration. If we suspect the user has been targeted for CSAE, we will follow the reporting process in Section 5.

3. Prohibited Content and Behavior

The following are strictly prohibited on our platform, with zero tolerance for violations involving minors:

● Any content that sexualizes, exploits, or endangers minors

● Uploading, sharing, or linking to any CSAM, including AI-generated or simulated content

● Using voice rooms or private messages to groom, solicit, or exploit minors

● Soliciting sexual content or personal information from anyone believed to be a minor

● Facilitating meetings between adults and minors for sexual purposes

● Using the App to coordinate, promote, or facilitate child trafficking

● Impersonating a minor to deceive other users

● Using coded language or symbols known to be associated with CSAE communities

● Attempting to move conversations with suspected minors to external platforms for exploitative purposes

● Harassment, bullying, or predatory behavior toward any user

4. Detection, Moderation, and Enforcement

We employ a combination of automated and human moderation to detect and remove CSAE-related content:

Automated detection: AI-powered systems scan text, images, and audio patterns for known CSAM indicators and grooming behavior patterns.

Human moderation: Trained moderation teams review flagged content and user reports, with dedicated specialists for CSAE cases.

User reporting: In-app reporting tools allow users to report suspected CSAE or underage users (see Section 7).

Immediate removal: Any content identified as CSAM is removed immediately upon detection, without prior notice. Accounts associated with CSAM are permanently banned.

When a violation is confirmed, we may:

● Remove the prohibited content

● Issue a warning, temporarily suspend, or permanently ban the user

● Report the user to law enforcement

● Report confirmed CSAM to NCMEC's CyberTipline

● Report the violation to Google Play

5. CSAE/CSAM Reporting Process

When we identify or receive a report of suspected CSAE or CSAM:

Immediate action (within 1 hour): Content is removed, the account is suspended, and the case is escalated to our Trust & Safety lead.

Review (within 24 hours): Trained moderators determine whether the case constitutes confirmed CSAE/CSAM.

NCMEC CyberTipline report: Confirmed CSAM is reported to the National Center for Missing & Exploited Children (NCMEC) via the CyberTipline, as required by U.S. law (18 U.S.C. § 2258A).

Law enforcement: Suspected criminal conduct is reported to appropriate law enforcement agencies.

Google Play notification: We notify Google Play through the Play Console reporting mechanism.

User notification: The reporting user is notified of the resolution (without disclosing law enforcement specifics).

CSAE/CSAM-related evidence is preserved solely for law enforcement reporting purposes and deleted after the legally required retention period.

6. Reporting Channels

Users can report suspected CSAE, CSAM, or underage users through two channels:

In-App Reporting: Go to the user's profile page, tap the More button, tap Report, select "Child Safety Concern" as the report reason, and complete the report.

Email Reporting: For reports that require detailed descriptions, supporting materials, or attachments, users can email service@nexaparty.com.

All reports are reviewed by our moderation team. Reports involving suspected CSAE or CSAM are treated as highest priority and addressed within 1 hour.

7. Data Protection for Minors

We do not knowingly collect, use, or disclose personal information from anyone under 16 without verifiable parental consent. In compliance with GDPR Article 8, we require parental consent for the processing of personal data of users under 16 (or the age of digital consent set by the applicable EU member state, which ranges from 13 to 16). If we learn that we have collected personal information from a user under 16 without proper consent, we will promptly delete that information.

If a parent or guardian believes their child has provided us with personal information, they may request deletion, access, or correction by contacting us at service@nexaparty.com. We will respond within 30 days and take reasonable steps to verify the requester's identity.

In alignment with Google Play's data restrictions and child safety best practices, we do not collect Android Advertising ID (AAID), SIM card serial numbers, MAC addresses, BSSID/SSID, IMEI/IMSI, or precise location data from users identified as below the required age.

8. Compliance with Laws and Platform Policies

We comply with all applicable child protection laws and platform policies, including:

● Google Play Child Safety Standards (including CSAE/CSAM requirements)

● Google Play Age-Restricted Content and Functionality Policy

● EU General Data Protection Regulation (GDPR), including Article 8 (digital consent age)

● U.S. Children's Online Privacy Protection Act (COPPA) — applicable to users under 13

● 18 U.S.C. § 2258A (mandatory CSAM reporting to NCMEC)

● UK Age Appropriate Design Code (Children's Code) and Online Safety Act

● EU Digital Services Act (DSA)

● California Consumer Privacy Act (CCPA) / California Age-Appropriate Design Code Act

● Australia Online Safety Act

We cooperate with all lawful requests from law enforcement agencies regarding CSAE investigations.

9. Staff Training and Governance

Our Trust & Safety team includes dedicated CSAE specialists responsible for reviewing reports, monitoring platform activity, and coordinating with law enforcement.

All staff with access to user data or moderation functions receive training on:

● Identifying CSAE and CSAM content and behavior patterns

● Recognizing signs of grooming and online exploitation

● Proper handling, escalation, and reporting of CSAE/CSAM cases

● Legal obligations for CSAM reporting

This policy is reviewed at least annually and updated as needed to reflect changes in applicable laws, platform policies, and industry best practices. We align our efforts with the Tech Coalition and Google's Fighting Child Sexual Abuse Online initiatives.

11. Updates to This Policy

We may update this Child Safety Policy from time to time. When we do, we will update the "Last Updated" date at the top, notify users of significant changes through the App or via email, and provide a summary of the changes. Your continued use of the App after the effective date constitutes acceptance of the updated policy.
